Terms of Service

Welcome to Whaisper. These Terms of Service ("Terms") govern your access to and use of the Whaisper voice delegation system, including our mobile application, Apple Watch app, website, forthcoming ring hardware, and related services (collectively, the "Service") operated by Whaisper ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your login credentials confidential and not share them with third parties.
• Accept responsibility for all activities that occur under your account.

3. Description of Service

Whaisper is a voice delegation system that combines AI agents with human supervisors. You delegate tasks by voice; AI agents execute them end to end, and human supervisors guard the exceptions. The Service is accessible today on iPhone and Apple Watch, with dedicated ring hardware in development. The Service includes:

• Voice-activated task delegation from iPhone, Apple Watch, and (in future) the Whaisper ring.
• End-to-end task execution by AI agents across email, calendar, phone calls, and the web.
• Human supervisors who review and resolve payments, negotiations, and genuine ambiguity.
• Integration with third-party services (calendar, email, travel, etc.) at your direction.

The Service is designed to assist with everyday tasks and is not a substitute for professional legal, medical, financial, or emergency services.

4. Founding Membership and Payments

• Founding membership requires a $100 fully refundable deposit.
• The deposit is fully refundable at any time before it is applied, by contacting executives@whaisper.com.
• Founding spots are admitted by application and in limited batches.
• The deposit unlocks one month of full access to Whaisper on iPhone and Apple Watch, and places you first in line for the Executive Service pilot.
• The Executive Service is offered at $1,000/month; the founding deposit converts into your founder ring deposit whenever you choose.
• Subscription pricing and payment terms for the ongoing Service will be communicated before you are charged.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights.
• Engage in fraudulent, abusive, or harmful activities.
• Request tasks that are illegal, unethical, or that could endanger any person.
• Attempt to reverse-engineer, decompile, or tamper with the Service or hardware.
• Interfere with or disrupt the Service's infrastructure or other users' access.
• Use the Service for automated or bulk activities without our consent.

6. Intellectual Property

All content, features, functionality, trademarks, and technology of the Service are owned by Whaisper and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

You retain ownership of any content you provide through the Service (messages, files, voice recordings). By using the Service, you grant us a limited license to use this content solely to provide and improve the Service.

7. Third-Party Services

The Service may integrate with or link to third-party services (e.g., calendar providers, email services, travel booking platforms). Your use of third-party services is governed by their respective terms and privacy policies. We are not responsible for the practices of third-party services.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that:

• The Service will be uninterrupted, error-free, or secure.
• Tasks will be completed with perfect accuracy or within specific timeframes.
• The ring hardware will be free of defects.

Product images on our website are concept renders. Hardware is in prototyping and may differ from renderings shown.

9. Limitation of Liability

To the maximum extent permitted by law, Whaisper shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Account Termination

You may terminate your account at any time through the app or by contacting executives@whaisper.com. We may suspend or terminate your account if you violate these Terms or engage in conduct that is harmful to other users or the Service.

Upon account deletion, we will remove your account and associated personal data in accordance with our Privacy Policy.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of San Francisco County, California.
